The case, filed in the United States Court of Federal Claims (sometimes referred to as the “Vaccine Court”) in Washington, D.C., sought recovery under the National Vaccine Injury Compensation Program.

SECRETARY OF HEALTH AND HUMAN SERVICES, the Petitioner, who at the time was 38-years old, received the MMR shot and shortly thereafter began to experience numbness in her torso, saddle and extremities, and also suffered dizzyness and imbalance.  After diagnostic studies, she was  diagnosed with Transverse Myelitis, a neurological disorder caused by inflammation across both sides of one level, or segment, of the spinal cord. Over a 13-month period she received treatment by oral and IV steroids.  She has made a partial recovery, and to this do suffers greatly from the affects of her vaccine injury from the MMR shot.

Transverse Myelitis and other reactions are continually reported to the Vaccine Adverse Events Reporting System (VAERS) as occurring after the MMR shot. Gold is a strong proponent of receiving all of the doctor-recommended shots.  Gold also says that while there is nothing inherently wrong with the MMR shot each person is different and reacts differently to each vaccination. That is why it’s essential that the public be aware of a Program intended to compensate them if they do, in fact, have a reaction.

Petitioners have three (3) years from the onset of the injury (or two years from date of death) to file a claim.
