What is Vaccine Injury Compensation Program?

Vaccines can save lives by preventing disease in the people who receive them. Most people who get vaccines suffer no serious reaction. However, vaccines, like any medication, can cause problems, such as severe allergic reactions. In those rare cases, the National Vaccine Injury Compensation Program (“VICP”), a Federal program, provides compensation to people found to be injured by certain vaccines. The VICP was created by Congress in 1986 as a no-fault system for resolving vaccine injury claims. It provides compensation to people found to be injured by vaccines.

Claims are paid by the Vaccine Injury Compensation Trust Fund. Funded by a $0.75 excise tax on vaccines recommended by the Centers for Disease Control and Prevention for routine administration to children, the excise tax is imposed on each dose of a vaccine. Monetary damages for vaccine injury victims as well as attorneys’ fees and costs are paid by the fund.

Vaccine injury claims are filed in the United States Court of Federal Claims in Washington, DC where they are heard by a special master. A lawyer from the Department of Justice, who represents the Secretary of Health and Human Services, will defend the case. If the special master finds that the individual suffered a vaccine injury, compensation will be awarded for the injured person’s past and future medical needs, future lost wages, and past and future pain and suffering.
