Gold law Firm, LLC attorney Howard S Gold recently filed a vaccine injury petition for compensation for a 56-year old Alabama women who had a severe reaction to the Flu Vaccine resulting in SIRVA, Shoulder Injury Related to Vaccine Administration. The case, filed in the United States Court of Federal Claims in Washington, D.C., sought recovery under the National Vaccine Injury Compensation Program.

The Flu Vaccine is designed to protect young and old alike from contracting influenza which can have devastating affects on the infirmed and elderly and can be debihilitating to otherwise healthy individuals, leading to more severe conditions.
In this most recent case, 16-vv-005 COS*** v. SECRETARY OF HEALTH AND HUMAN SERVICES, the Petitioner, who at the time was 54-years old, received the Flu Vaccine and shortly thereafter began to experience severe pain and swelling in her left shoulder. She then went on to have additional pain, numbness and loss of the use of her left arm and pain into her neck. She was quickly diagnosed with SIRVA, required exploratory surgery and spent more than six (6) months receiving physical therapy and taking pain medication. She has made an incomplete recovery. SIRVA and other reactions are continually reported to the Vaccine Adverse Events Reporting System (VAERS) as occuring after the Tdap, Influenza and other vaccines. Gold also says that there is nothing inherently wrong with the Flu Vaccine but that each person is different and reacts differently to each vaccination. That is why it’s essential that the public be aware of a Program intended to compensate them if they do, in fact, have a reaction.
Petitioners have three (3) years from the onset of the vaccine injury (or two years from date of death) to file a claim. Gold states that the “Vaccine Injury Program is not used as much as it could be because the American public is just not aware of it. I receive at least 5 calls a month from individuals who cannot obtain compensation because the deadline has passed. They just found out about it too late. We all need to do a better job in getting the word out to the public that the Program exists.”
